Last month, Mother Monster (real name: Stefani Germanotta) filed a complaint with the National Arbitration Forum over the website, which she claimed had been registered in violation of her trademark.
According to Germanotta’s camp, the site was intentionally registered “to capitalize on Lady Gaga’s fame” and was “disrupting Lady Gaga’s ability to promote herself and her endeavors.”
The fan who operates the site disagreed, saying it was a non-comercial venture that supports the performer and gives her free publicity. She argues that LadyGaga.org, which was registered in June 2008, “does not have any sponsored links or links to third-party websites which market and sell merchandise” bearing Gaga’s name, and therefore represents “fair use.”
Arbitrators agreed, ruling that Germanotta failed to demonstrate that the fan had registered the site “in bad faith” or without “rights or legitimate interests in respect of the domain name.”
“[Lady Gaga] cannot have fame without fans and fans cannot have fan sites without referring to the objects of their adoration,” concluded the panel.
Therefore, LadyGaga.org is allowed to continue under present ownership.'
