Ed Sheeran has suited up to make another appearance in courts.
After last year’s lawsuit against the British song-writer by Chokri for allegedly copying their song “oh, Why”, many crossed their fingers for a break for Sheeran. But not life has other plans for him as he’s now being sued by Marvin Gaye’s song-writers,
The heirs of Ed Townsend the co-writer of Marvin Gaye’s mega hit “Let’s Get It On” has sued the Brit alleging that there are “striking similarities” between the 1973 soul classic and Sheeran’s 2014 “Thinking Out Loud” stating that there are “‘overt common elements’ that violate their copyright”
The lawsuit filed in 2017 finally made it to New York courts last week and is now being debated over a Manhattan Federal Jury in the Courts of 95-year-old Judge Louis L. Stanton.
Sheeran's attorneys have said "The two songs share versions of a similar and unprotectable chord progression that was freely available to all songwriters," noting the undeniable structural symmetry points only to the foundations of popular music.
Townsend’s attorneys also made the point that over the years many artists have made covers or mash-ups or segued into the song including Charlie Puth, Boyz II Men which have never seen the lights of a courts of law all due to the artists going about the song making route the right way. Unlike them Sheeran falls onto the group of artists who did not go about it correctly and were ultimately sued by Gaye’s team including the likes of Robin Thicke, Pharrell Williams & T.I who in a losing battle were sued for “resemblances” between their 2013 hit “Blurred Lines” and Gaye’s 1977 song “Got To Give Up”.
Ultimately the jury awarded Gaye's heirs $7.4 million at trial -- later trimmed by a judge to $5.3 million -- making it among the most significant copyright cases in recent decades.
